Multiple people have filed wrongful death lawsuits after a loved one died from a heart attack after consuming the popular Monster Energy drink. Some of these suits have been settled outside of court, and it is believed that the first actual Monster Energy wrongful death trial will begin in April of this year.
According to a FoxNews article, the personal injury lawsuit was filed by the family of Alex Morris. Morris, 19, died in 2012 after consuming multiple Monster Energy drinks which his family claims caused him to suffer a heart attack. In their Monster Energy lawsuit, Morris’ family claims that the young man was a habitual drinker of the beverage and that this caused a gradual deterioration of his heart, leading to fatal cardiac arrhythmia and cardiomyopathy. Attorneys for the Morris family claim that the makers of this beveragefailed to publish and post adequate warnings about the risks of “caffeine toxicity”.
In many Monster Energy drink lawsuits, plaintiffs claim that the beverage is not safe for young children and teens, though it is aggressively marketed to this demographic. The company is also the defendant in a lawsuit brought by the City Attorney of San Francisco,who claims that marketing a product unsafe for children to such a young market violates California law. Similar lawsuits have been filed against the makers of Red Bull, Rockstar, and other energy drinks.
In addition to these lawsuits, the FDA is also investigating the safety of energy drinks after receiving multiple reports of serious health events or deaths linked to these beverages.
